1. Acceptance of Terms
By downloading, installing, or using AmberTime ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
2. Description of Service
AmberTime is an iOS application that performs incremental backup of photos, videos, and files from your iPhone to external physical storage devices (USB drives, SD cards, external SSDs). The App operates entirely offline and does not provide any cloud storage or network-based services.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, as permitted by the App Store Terms of Service.
4. User Responsibilities
You are responsible for:
- Ensuring your external storage device is functioning properly and has sufficient space
- Safely ejecting and handling your external storage devices
- Maintaining additional copies of important data (the App is one layer of backup, not a sole backup solution)
- Keeping your device's operating system updated to a compatible version
5. Data and Privacy
The App processes your photos, videos, and files solely for the purpose of creating backups on your chosen external storage device. All data remains on your device and your external storage. We do not access, collect, store, or transmit your data. Please refer to our Privacy Policy for full details.
6. Intellectual Property
The App, including its design, code, graphics, and documentation, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted, error-free, or free of harmful components
- Warranties regarding the reliability, accuracy, or completeness of any backup
While we strive to make the App reliable, no backup software can guarantee 100% data integrity. We strongly recommend maintaining multiple backup copies of important data.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, photos, videos, or files
- Damage to external storage devices
- Loss of profits or revenue
- Interruption of business
Our total liability for any claim arising from use of the App shall not exceed the amount you paid for the App.
9. External Storage Devices
The App interacts with third-party external storage hardware. We are not responsible for:
- Hardware failures, defects, or incompatibilities of external storage devices
- Data corruption caused by faulty hardware, improper ejection, or power loss
- File system limitations (e.g., FAT32 4 GB single file limit)
10. Updates and Changes
We may update the App from time to time. Updates may modify or remove features. Continued use of the App after an update constitutes acceptance of any changes. We may also update these Terms; the revised version will be posted on this page.
11. Termination
You may stop using the App at any time by deleting it from your device. We reserve the right to discontinue the App at any time without notice.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
